TERMS AND CONDITIONS OF SALE

Effective as of October 27, 2025

These Terms and Conditions of Sale (hereinafter "T&C") govern the distance sales of products offered by COUTUMES, a simplified joint-stock company with capital of €9,000, registered with the Paris Trade and Companies Register under number 979 640 125, whose registered office is located at 55 rue d'Amsterdam, 75008 Paris, France, represented by Fifi La Plume, herself represented by Mr. Edouard de Langalerie.

The website www.coutumes.com is available in French and English. The language chosen by the Customer when ordering will be used for the conclusion of the contract and associated exchanges.

Validation of an order implies full acceptance of these T&C. The T&C may be modified at any time. The applicable version is the one in force on the day of the order.

ARTICLE 1. ORDER AND CONTRACT FORMATION

1.1 Placing an Order

The Customer places an order by following these steps:

1. Product selection and adding to cart
2. Cart validation and summary review
3. Entry or validation of customer information
4. Choice of delivery method (home delivery or Click & Collect)
5. Secure payment

1.2 Order Confirmation

After payment acceptance, a confirmation email is sent to the Customer. The sales contract is then formed.

1.3 Click & Collect (Paris only)

Customers can choose to collect their order at our Paris boutique:

• Address: 50 rue des Francs-Bourgeois, 75003 Paris, France
• Process: Option available when selecting delivery method at checkout
• Timeframe: Order available within 2-4 business days

1.4 Order Refusal

COUTUMES reserves the right to refuse an order in case of previous payment incident, proven or suspected fraud, or service abuse.

ARTICLE 2. PRICES AND PAYMENT

2.1 Prices

• Prices are displayed in euros
• European Union: All taxes included (TTC/VAT included)
• USA: DDP delivery - all taxes and duties included, no fees upon arrival
• Outside EU (except USA): DAP delivery - taxes and duties payable by Customer upon arrival
• Prices may be modified at any time, but confirmed orders remain at the price applied at purchase

2.2 Payment Methods

Payment accepted by:

• Credit card (Visa, Mastercard, American Express)
• PayPal

2.3 Payment Security

Payment is secured via Shopify Payments with SSL protocol. No banking data is stored on our servers.

ARTICLE 3. PRODUCTS

Essential product characteristics are presented on each product page. Photographs are non-contractual. Products remain the property of COUTUMES until full payment of the price.

ARTICLE 4. DELIVERY

4.1 Carriers

Colissimo, Chronopost, and international express carriers

4.2 Indicative Delivery Times

• France: 2-4 business days
• Europe: 4-7 business days
• USA: 8-15 business days
• International (outside EU/USA): 8-30 business days depending on customs

The maximum legal delivery time is 30 days.

4.3 Risk Transfer

Risks are transferred to the Customer upon delivery of the package. In case of damage, the Customer must file a claim with the carrier and immediately contact customer service.

ARTICLE 5. RIGHT OF WITHDRAWAL AND RETURNS

5.1 Right of Withdrawal

Customers have 30 days from receipt to exercise their right of withdrawal.

5.2 Eligibility Conditions

• New product, never worn
• Original condition with packaging and tags
• Return within the 30-day period
• Exclusions: Personalized, engraved, or damaged items

5.3 Return Procedure

Option 1: Return by Mail (Baback)

1. Declaration via customer account or Baback return tool
2. Print return form
3. Send EXCLUSIVELY to the following address:

Option 2: In-Store Return (Paris only)

• Drop-off possible at 50 rue des Francs-Bourgeois, 75003 Paris
• For online orders: processing and refund handled only by e-commerce service

5.4 Costs and Refund

• Return shipping costs are borne by the Customer (except for defective products)
• Refund to original payment method within 14 days after receipt and inspection

ARTICLE 6. DEFECTIVE OR NON-CONFORMING PRODUCTS

In case of error, missing product, or defective item, the Customer must contact customer service. A replacement or refund will be offered. A prepaid return label will be provided if necessary.

ARTICLE 7. WARRANTIES

• Legal warranty of conformity: 2 years for EU customers
• Warranty against hidden defects: According to applicable law
• COUTUMES commercial warranty: 2 years excluding normal wear, impact, loss, oxidation, or misuse
  

ARTICLE 8. PERSONAL DATA PROTECTION

8.1 Collection and Use

COUTUMES collects and processes personal data in accordance with GDPR and applicable legislation:

• Purposes: Order management, deliveries, customer service, and marketing communications (with consent)
• Legal basis: Contract execution and consent for marketing communications
• Retention period: 3 years for active customers, legal archiving according to accounting obligations

8.2 Your Rights

You have the following rights:

• Access, rectification, and deletion of your data
• Opposition to processing and limitation
• Data portability
• Withdrawal of consent at any time for marketing communications

ARTICLE 9. INTELLECTUAL PROPERTY

All website elements (texts, images, logos, trademarks) are protected by intellectual property law. Any reproduction or exploitation without written authorization is prohibited.

ARTICLE 11. MEDIATION AND DISPUTES

11.1 Mediation

In case of unresolved dispute with customer service, the Customer may contact a consumer mediator free of charge. Mediator designation in progress.

11.2 Applicable Law

These T&C are governed by French law, subject to mandatory provisions more favorable to the consumer in their country of residence.

11.3 Jurisdiction

• EU Customers: Courts of Paris or consumer's place of residence
• Non-EU Customers: Disputes shall be resolved through international arbitration under ICC rules

ARTICLE 12. INTERNATIONAL SHIPPING SPECIFICS

12.1 Customs and Import Duties

• USA: All duties and taxes included (DDP)
• Other countries: Customer responsible for customs duties and taxes (DAP)
• COUTUMES is not responsible for customs delays

12.2 Restricted Countries

We do not ship to countries under international trade sanctions. Full list available on request.

12.3 Currency

All transactions are processed in euros. Exchange rates applied by your payment provider.
